Affiliate Program Agreement

This Affiliate Program Agreement (“Agreement”) is entered into between Be Your Best AS, a company incorporated and registered in Norway with its principal place of business at Gaustadalléen 21, 0349, Oslo, Norway (“Company”, “we”, “our”, or “us”), and you, the affiliate applicant (“Affiliate”, “you”, or “your”).By applying to and participating in our Affiliate Program (“Program”), you agree to be bound by the terms of this Agreement. If you do not agree, you may not participate in the Program.

‍1. Enrollment and Eligibility

‍1.1. To participate, you must complete the affiliate application form truthfully and accurately.

1.2. We reserve the right to accept or reject any application at our sole discretion.

1.3. We may terminate your participation at any time if we determine that you have violated this Agreement or engaged in conduct that is harmful to our interests.‍

2. Affiliate Responsibilities

‍2.1. You agree to promote our products and services in a lawful, ethical, and responsible manner.

2.2. You must not:

• Engage in spam, misleading, or deceptive marketing practice
• Promote our products on sites containing illegal, harmful, or offensive content.
• Use our brand trademarks, logos, or other intellectual property without prior written approval.
• Bid on our branded terms in search engine marketing without explicit permission

3. Commission and Payment

3.1. You will earn commission on qualifying sales generated directly through your unique affiliate link.

3.2. A “qualifying sale” means a completed purchase by a referred customer, for which we have received full payment.

3.3. Commissions are not payable where sales were not fairly earned, including but not limited to:

• Use of coupon or discount aggregator websites.
• Fraudulent or abusive activity.
• Self-referrals or orders placed by the Affiliate themselves.

3.4. Commission payments will be processed within thirty (30) days after the referred customer’s payment is successfully completed and cleared.

3.5. Payments will be made through the method specified in your affiliate account. It is your responsibility to ensure your payment details are accurate and up to date.

4. Term and Termination

4.1. This Agreement will begin upon our acceptance of your application and will continue until terminated by either party.

4.2. You may terminate your participation at any time by providing written notice.

4.3. We may terminate your participation immediately at our discretion, including if we suspect fraud, abuse, or violation of this Agreement.

4.4. Upon termination, you will no longer be eligible to earn commissions, and any unpaid commissions that were not legitimately earned may be withheld.

5. Intellectual Property

5.1. We grant you a limited, non-exclusive, revocable right to use links, banners, and other promotional materials we provide for the sole purpose of promoting our products in accordance with this Agreement.

5.2. You may not alter, modify, or create derivative works of such materials without our prior written consent.

6. Limitation of Liability

6.1. We make no warranties regarding the Affiliate Program, our products, or the potential to earn income.

6.2. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising in connection with this Agreement or your participation in the Program.

7. Governing Law and Jurisdiction

7.1. This Agreement shall be governed by and construed in accordance with the laws of Norway.

7.2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Norway.

8. Modification of Terms

‍8.1. We may update or modify this Agreement at any time.

8.2. You will be notified of material changes via email or through the affiliate dashboard.

8.3. Continued participation in the Program after such changes constitutes your acceptance of the updated Agreement.

By checking the box during sign-up, you confirm that you have read, understood, and agree to be bound by this Affiliate Program Agreement.
